LEGAL REGULATION OF INFLUENCE OF INDUSTRIAL ENTERPRISES ON THE STATE OF ATMOSPHERIC AIR: UKRAINIAN AND EUROPEAN ASPECTS

Abstract
This article is devoted to the study and coverage of the current state of atmospheric air pollution in Ukraine as a result of the activities of industrial enterprises, which every year make a greater release of toxic substances into the atmospheric air not only of our state, but also of the world as a whole. In the main part, an analysis of the current norms of national legislation in the field of atmospheric air protection was carried out, namely: the Law of Ukraine "On Environmental Protection", the Law of Ukraine "On Environmental Protection", the Law of Ukraine "On Environmental Impact Assessment", where the obligatory mechanism for assessing the environmental impact is fixed before the business entity begins to carry out its activities, the norms governing the procedure for conducting inspections (both planned and unscheduled) by relevant us, which avoids most of the companies liable for non-normalized emissions of polluting substances into the air. Also, the norms of European legislation were examined, where this issue is more clearly regulated and fixed at the level of directives that will reduce the amount of hazardous emissions and the corresponding programs for encouraging business entities are formed. An analysis is made of state policies in the sphere of protection of atmospheric air from a large amount of polluting emissions fixed at the level of the Law of Ukraine and ways to reduce such emissions primarily by large enterprises of Ukraine. At the end of the study, it was proposed to apply the principle of greening the entire sphere of enterprises, that is, the transition to such methods and fundamentals of management that ensure optimal use of resources, to the introduction of innovative environmental technologies for production and environmental management. The findings suggested ways to improve domestic legislation by introducing mechanisms through the ratification of a large number of Convention Directives and Agreements.
