PROSPECTS AND CHALLENGES IN APPLICATION OF THE CENTRALIZED MODEL OF CONSTITUTIONAL PROTECTION IN VIETNAM

Abstract
The article offers the answer to the questions: “Why does the centralised model of constitutional review prove applicable to Vietnam?”, and “if applied, what prospects and challenges will the model face?”. The findings of much research indicate that Vietnam's current judicial and political attributes are similar to those of Europe hundreds of years ago, when Civil-law countries were constructing their model of constitutional review. These attributes also explain why Europe did not choose the decentralised model (the American model). There are prospects that the application of the centralised model will quickly prove suitable for Vietnam's context and will help pursue the goal of creating rule-of-law politics and social life.
