INSPECTION AND SEARCH OF A VEHICLE REGISTERED OUTSIDE UKRAINE

Abstract
The article is devoted to some aspects of investigative (search) actions in the «other person's possession», namely in a vehicle. The study revealed that today in Ukraine there are a large number of vehicles that have not passed the customs inspection procedure and are not registered with the relevant bodies of the Ministry of Internal Affairs, that is the abovementioned vehicles are in the territory of our country on the right of «temporary import» or «transit». In some cases that they are used by citizens of Ukraine as an instrument for committing a crime, therefore, quite often, law enforcement officers need to conduct certain investigative (search) actions on them, namely inspection and search. It is established that the inspection and search of a vehicle that is registered abroad, but located on the territory of Ukraine, is conducted according to the same grounds as to the vehicle registered on the territory of Ukraine. A proper scientific research claims that Article 30 of the Constitution of Ukraine equally «protects» both vehicles that belongs to a citizen of Ukraine and a vehicle that belongs to a non-resident of Ukraine or a foreign company.
