MODERN STATE OF UKRAINIAN ENVIRONMENTAL LEGISLATION IN THE FIELD OF AIR QUALITY: ADAPTATION TO EU STANDARDS

Abstract

The scientific work identifies atmospheric pollution as one of the most pressing problems of today, and legislative regulation in this area is recognized as one factor that will make it possible to solve it. The advantages of the European legislation and consequences of the implementation of such norms in the Ukrainian regulatory framework are outlined. The fact of the progressiveness of the normative regulation in the field of air quality in the Member States of the European Union is ascertained, and the provisions of the air quality normalization systems of the EU and Ukraine are compared. The article also identifies the problems of the regulatory system of Ukraine at the current stage of adaptation of environmental legislation in the field of air quality to the current one in the EU. Relevant European legislation in force in this field is reviewed, guidance on standardization and alignment of other countries' legislation on atmospheric air quality is given, and the expected results after implementation of such standards are analyzed. The article examines already existing norms of Ukrainian legislation that have been amended or created by adapting domestic norms to the relevant EU standards. The success of this experience is confirmed by the statistics provided that demonstrate the effectiveness of the selected monitoring and evaluation strategies for the air. The opinions of scientists and their positions on ways of further ensuring the approximation of the environmental legislation in the field of environmental integration to the EU are analyzed. In order to confirm the need for further adaptation, specific examples of regulatory acts that have been brought into line with EU standards in the field of atmospheric air quality have been cited. In the course of analyzing the provisions of such legislative acts and statistics, the conclusion was made about the successful implementation of EU norms and the need for further implementation of such changes in the regulatory framework of Ukraine.
