Abstract

The article reveals the essence of the concept of defensive speech of a lawyer in criminal proceedings. Issues related to the psychological features of the construction of a lawyer's speech are covered. It is noted that the activity of a defense attorney in court proceedings is one of the necessary conditions and guarantees of objectivity of the trial and a fair decision, because it completes the large and complex work of defense counsel, which aims to protect the rights and legitimate interests of the defendant. in order to prevent a possible mistake to the detriment of the defendant, to exclude criminal liability and conviction of the innocent. The importance of the correct structure of a lawyer's speech, which should consist of an introduction, main part and conclusion, is analyzed. The main elements of a lawyer's qualitative speech, such as conciseness, logic, consistency, are identified. Attention is drawn to the fact that court speech is not only a means of legal proceedings, but is a powerful tool of a lawyer's professional activity. In addition, the article reveals the distinctions between the models of presentation of facts in speech. They can be divided into classical, fact-oriented, subjective, which is focused on the speaker and the model of refutation of the position, oriented on the opponent. Each of these models has its pros and cons. According to the current legal position, a lawyer in his practice uses the most optimal to provide quality professional legal assistance to the client. After analyzing the various types of psychological impact in legal activities, they can be divided into acceptable and unacceptable. It is concluded that the knowledge of psychology is somehow manifested in the speeches of the defender. The lawyer's speech should be correct, convincing, substantiated, sometimes penetrating and emotional, «imbued» with respect for justice.
