CRIMINAL DELINQUENCY: POSITIVE AND NEGATIVE ASPECTS OF IMPLEMENTATION IN NATIONAL LEGISLATION

At the article considered the institution of criminal delinquencies. Particular attention is paid to the disclosure of the concept of «criminal delinquency». The views of scientists on the introduction of this institute into the legislation of Ukraine are considered in detail. The main emphasis of the research is on the disclosure of the positive and negative aspects of the use of criminal delinquency and its normative fixing in the Criminal Code of Ukraine. The problems related to the definition of the concept of «criminal delinquency», the criminalization of certain administrative offenses, the refusal of criminal convictions for committing a criminal offense, etc., are emphasized. The Law of Ukraine «On Amendments to Certain Legislative Acts of Ukraine on Simplifying Pre-trial Investigation of Certain Categories of Criminal Offenses» is being analyzed, which comes into force from the first of July 2020.
