BLOCKCHAIN IN UKRAINE: PROBLEMS OF LEGAL REGULATION

The article examines the state of legal regulation of blockchain technology and cryptocurrency, as well as analysis of the legislation regarding the prospects for the introduction of these latest technologies in Ukraine. Due to the reasons for the emergence of a new phenomenon, cryptocurrency, but it is not the accountability of the other participants in the financial market of emission of American dollars and the use of new methods of calculation and accumulation of capital throughout the world. Define the concept of «cryptocurrency and the conditionality of the creation of the concept of scriptorially». It turns out the question about whether cryptocurrency and blockchain technology to take their place in Ukraine, as well as the impact of the introduction of this digital currency in the financial system of Ukraine and definition of all risks the introduction of such technology at a national scale. Identified major gaps and shortcomings in the legislation, various legal acts of Ukraine concerning the cryptocurrency and activities cryptanalytic exchanges proposed alternative solutions to the use of cryptanalytic according to the experience of foreign developed countries, the ratio of and ability to comply with the legislation of Ukraine in this sphere, as well as possible improvements and remedy deficiencies in the legislation. Identified which define the status of crypto-currencies have the complexity and volume of changes in legislation. Analyzed and reviewed state regulatory legal acts on the subject idea of cryptocurrency and its status, namely the main characteristics and differences between electronic money and virtual currencies, as well as the advantages and disadvantages of its application as a new financial instrument and the latest technology. The prospects and dangers of the use of cryptanalytic in Ukraine. Arguments why the technology of the blockchain has huge potential and will help to create a brand new infrastructure in the financial sector. Considered controversial issues of the introduction of cryptocurrencies arising from the emergence of a new potential tool for money laundering, the use of technology in the drug business and other criminal acts. Convincingly, the conditionality of reducing crime and minimizing the risks of a competent legal technique of law-making.
