Abstract
This article is devoted to the study of the problems of proving reliability in criminal proceedings. The problems of proof that arise at the present stage of the development of criminal proceedings are related to the assessment of their reliability, as a category that reveals the material truth. Analyzing the norms of substantive and procedural law, the author identified some shortcomings and contradictions between the norms. When implementing the tasks of criminal proceedings, taking into account the current situation, we can talk about a violation of the principle of legality. The author sees possible ways to eliminate the existing contradictions, focusing on a new approach to reliability as one of the characteristics of evidence.
