DEVELOPMENT OF BIOENERGY IN UKRAINE: ISSUES OF LEGAL REGULATION

Abstract

The article deals with the legislative framework for the development of the energy sector of the economy, in particular, the issues of energy production from alternative sources, among which one of the leading places, along with the energy of the sun and the wind, is biomass and biogas. The situation of the world energy market is investigated, which minimize a negative impact on the natural environment, as well as trends in the development of this industry in Ukraine. It is stated that bioenergy is one of the strategic directions of the development of the renewable energy sector, taking into account the high dependence of the country from imported energy sources, primarily natural gas, and a large potential of biomass available for energy production. However, unfortunately, the growth rate of bioenergy in Ukraine is still substantially lagging behind European. It is noted that legislative support for the use of bioenergy in Ukraine as a source of alternative energy is heterogeneous character, characterized by, first of all, the large number of subordinate legal acts, general-declarative legislative norms, as well as some inconsistency of legal regulation. The periodization of legislative regulation of bioenergy development in Ukraine was carried out, namely the following stages: introduction; formation and development; interaction and partnership; modernization. The main normative legal acts of these stages are singled out, and their features and the direction of legal regulation are analyzed. In addition, it emphasized that Ukraine's accession to European initiatives, as well as the borrowing of international experience in this area should have a positive effect on the energy balance and provide the development of the sector, in particular, in the perspective of the need to create a full competitive environment on the energy market of Ukraine; changes in the thermal generation of renewable energy sources and the implementation of full transformation of coal regions, which means the gradual closure of unprofitable enterprises with parallel creation in these regions of alternative workplaces.
