PECULIARITIES OF EXPLOITATION OF APARTMENT BUILDINGS IN THE CONDITIONS OF MARTIAL LAW: NEW ADMINISTRATIVE AND FINANCIAL EMPHASIS

Abstract

The article analyzes the legal, social, economic and psychological aspects of the operation of multi-apartment housing under martial law. The shortcomings of the Law of Ukraine «On association of co-owners of an apartment building» are revealed. It identifies the risks that appear as a result of such shortcomings and errors. Attention is focused on the need to submit documents confirming the right of ownership in order to apply for election as a member of the board of condominiums for owners, co-owners and their representatives. The need to amend Article 6 of the Law of Ukraine on Association of Co-Owners of Apartment Buildings for the opportunity to participate in general meetings of condominiums and to have the right to elect and be elected to the homeowner association is emphasized. Attention is drawn to the problems and violations of the management of an apartment building as a result of imperfect legislation. An autonomous scheme of operation and provision of generation and uninterrupted power supply of an apartment building under martial law conditions is proposed. Attention is focused on the necessary development for each multi-apartment building of a system of uninterrupted supply of energy carriers to residents and the removal of all prohibitions and restrictions on the installation of individual heating by residents in multi-apartment buildings. Attention is drawn to the creation, if technically possible, of a safe shelter with a central alarm system and all the benefits in each multi-apartment building. It is emphasized the need to create a military reserve fund of condominiums, to carry out urgent repair and restoration works as a result of damage to the building and the adjacent territory from military operations, as well as to elect a person responsible for civil defense from among the board members. Sources of income for its formation are indicated. It is emphasized the importance of timely payment of membership fees and communal services in martial law conditions to ensure the fulfillment of all obligations of the condominium under contractual relations regarding the lighting of common areas, maintenance of elevators, cleaning of adjacent areas, etc., which will contribute to the establishment of social, organizational and psychological stability in society, necessary for victory.
