ADMINISTRATIVE AND LEGAL STATUS OF THE NATIONAL HEALTH SERVICE OF UKRAINE

Abstract
The article analyzes the state and prerequisites for the formation of the administrative and legal status of the National Health Service of Ukraine as a central executive body. A number of problems in the activity of such a body related to the organizational structure of its main function—to be the guarantor of proper medical care for citizens on equal opportunities and declared free medical care are considered. The focus is on the organizational problems that the health care system of Ukraine is currently experiencing in the fifth year of functioning of the National Health Service of Ukraine. Among them, first of all, the transition to a decentralized health care system, which took place several decades ago, on the one hand, and the system of health care institutions of state and communal property, which literally cemented form existed for several decades, and only in recent years has undergone modern reforms that provide for the transition from the administrative and managerial model to the organizational independence of the institution, from a non-alternative territorial (especially on the periphery) model provision of services to a competitive environment for the provision of medical services, the patient's ability to make an informed choice, to influence the organizational structure of medical care in his territory. The administrative and economic aspects of the legal status of the National Health Service are also considered as a structure that assumes, in addition to organizational functions, the economic functions of a single customer of medical services and medicines. Thus, both administrative and economic powers are concentrated in this body, which makes its legal status quite specific, since control over the activities of health care institutions in classical administrative terms based on data request, studying the situation and making administrative decisions no longer works in the modern multistructural economy. Instead, public administration in the field of health care, which requires a special legal status of the bodies that carry it out, comes to the fore. The modern mechanism of control in the medical sphere is a verification of the effectiveness of a health care institution using indirect and more effective indicators, such as the number of persons who have submitted declarations of medical care in this institution, the level of their satisfaction with the medical services provided, as evidenced by both the number of appeals submitted to the National Health Service of Ukraine and the dynamics of submission and withdrawal of declarations on medical care with doctors of this health care facility. Thus, the legal status of the National Health Service of Ukraine consists of both organizational and legal opportunities to influence the controlled sphere, as well as financial, economic, information and analytical, etc.
