PROTECTION FOR THE AI-GENERATED OBJECTS: THE RELEVANCE OF COPYRIGHT PROTECTION OF PHOTOGRAPHS

Introduction. The article examines the presence and practical applications of artificial intelligence (AI) in various areas of everyday life, such as search algorithms and intelligent assistants. Highlights the recent boom in machine learning and AI technologies and questions whether generative creations created by AI can be copyrighted. The article examines a case where the US Copyright Office refused to register a comic created using AI-generated images. The text argues for the need to study the relevance of protecting generative creations, comparing them with the nature of photography. Purpose. The purpose of the article is the need to find out whether the hypothesis that a generative creation created by AI is close in nature to photography and, accordingly, the history of copyright protection of photographs is relevant to the protection of generative creations. Materials and methods. The research materials are: 1) regulatory and legal provision regarding copyright; 2) works of domestic and foreign authors conducting scientific and practical research on the interaction of AI and copyright. Results. The relevance of the experience of copyright protection of photography to generative creations was analyzed, as well as the decision of the Ukrainian legislator to introduce a special kind of right for non-original objects generated by a computer program, which is the right direction for the development of the protection of generative creations with minimal harm to the interests of the author, despite on the debatable characteristics of such an object, specified in the study. Prospects. AI is a new technology that raises questions in various areas of law, including copyright, consumer rights, and personal data security. The article laid the foundation for further research on the issue of protection of generative creations and their impact on the author's interests.
