Abstract

Introduction. The notary profession plays an important role in ensuring legal stability and trust in the legal system in many countries, including Ukraine. As professional representatives, notaries are responsible for providing services for notarization of documents, certification of signatures and other legal actions that are crucial for personal and commercial affairs of citizens and businesses. However, due to the high responsibility and complexity of notarial activity, notaries may face risks related to errors, losses or complaints from clients. These risks can have serious financial and reputational consequences for notaries, underscoring the need to properly protect their interests. One of the widely used and effective tools for protecting notary public liability is insurance. Professional liability insurance provides notaries with financial protection and coverage of costs related to the resolution of disputes and compensation for losses that may arise in the course of their professional activities. It helps notaries avoid serious financial and legal consequences, ensures the preservation of their reputation and trust of clients. Professional liability insurance of a notary is an important element of ensuring the quality of notary services and protecting the interests of clients. The sources of such insurance may be insurance companies that specialize in professional liability insurance or notary associations that may provide their members with the opportunity to join joint insurance programs. In order to obtain an insurance policy, a notary must provide evidence of his qualifications and the absence of previous cases of violation of professional standards. The insurance policy can cover the cost of indemnifying the damages caused to the clients due to errors or negligence of the notary public. In addition, professional indemnity insurance may include other types of coverage, such as protection against lawsuits, reimbursement of legal fees and other costs associated with legal proceedings. It is important to note that professional indemnity insurance is not mandatory for notaries, but it may be a requirement of individual clients or a condition for obtaining a notary license. In general, professional liability insurance is an important tool for ensuring the quality of notarial services and protecting the rights and interests of clients. Purpose. The purpose of the study is a detailed analysis of current sources of the notary professional liability insurance contract and determination of their features. Materials and methods. The research materials are: 1) regulatory and legal support for the regulation of the notary's professional liability insurance contract; 2) the works of domestic and foreign authors conducting their scientific and practical research in the field of insurance, namely in relation to notary professional liability insurance. The following scientific methods were used during the scientific research: theoretical (for a general description of the types of civil liability insurance); comparative legal (comparison of systems of formation of sources of professional liability insurance of notaries on the example of foreign countries), analysis and synthesis (systematization, generalization and comprehensive study of foreign and domestic legislation, which regulates the features of professional liability insurance of notaries); formal-logical (in the process of summarizing research results and formulating conclusions). Results. In this scientific article, various aspects regarding sources of notary liability insurance were considered.
