STATE PROTECTION IN UKRAINE FOR HEADS OF FOREIGN STATES AND OFFICIALS OF INTERNATIONAL ORGANIZATIONS UNDER MARTIAL LAW

Abstract

It is known that in connection with the large-scale armed aggression of the Russian Federation against Ukraine and for the purpose of ensuring the security and defense of the state, the protection of the Ukrainian people, on February 24, 2022, in wartime conditions, the Decree of the President of Ukraine dated February 24, 2022 No. 64/2022, martial law was introduced in Ukraine. The Russian Federation is an aggressor state, a terrorist state and a state sponsor of terrorism, and its actions are genocide of the Ukrainian people. The President of the Russian Federation V. Putin is a war criminal and terrorist No. 1 in the world, who is supported by the top political and military leadership of Russia, the russian orthodox church and some pro-Russian politicians in European countries. Russians are happy with it because they are an immoral society. The war of the Russian Federation against Ukraine and in Ukraine showed the weakness of the international security system to counter armed aggression and terrorism. In view of the above, the purpose of the article is to formulate scientifically based proposals for state protection in Ukraine in relation to heads of foreign states and officials of international organizations in the conditions of martial law, in the context of the armed aggression of the Russian Federation against Ukraine. According to the results of the study, it was found that in the conditions of wartime, it is necessary to significantly strengthen and improve security in Ukraine for heads of foreign states and members of their families. This is possible by increasing the functional capabilities of the Department of State Guard (DSG) of Ukraine, strengthening the requirements for its personnel and on the basis of ensuring proper interaction of the DSG of Ukraine with the security bodies of foreign countries, in accordance with international treaties of Ukraine, with other bodies that are part of the security and defense forces of Ukraine. It is also extremely important to ensure proper state protection in Ukraine for officials of international organizations who arrive in Ukraine or stay on its territory as part of official delegations or visit Ukraine at the invitation of the President of Ukraine or state authorities, in wartime conditions. Such visits of foreign delegations to Ukraine, international contacts and cooperation during the Russian-Ukrainian war contribute to strengthening the potential and enhance the position of Ukraine on the international arena to ensure reliable and appropriate practical, tangible support at the international level for the sovereignty, territorial integrity and independence of Ukraine, its economic, financial, information, food and energy security, etc. And they are also quite important and extremely valuable for Ukraine in order to protect the civilian population during the war and during the liberation of all the territories of Ukraine captured by Russia, including the Ukrainian Crimea. The conclusion was drawn that under such circumstances and under wartime conditions, the level of security in Ukraine for heads of foreign states and officials of international organizations under martial law should be adequate. In this regard, it is necessary to Art. 7 of the Law of Ukraine «On State Protection of State Authorities of Ukraine and Officials» to add a new part with the following content: «In the conditions of martial law, a mandatory list of officials of international organizations subject to state protection is approved, which is determined by the President of Ukraine, based on proposals National Security and Defense Council of Ukraine».
