Abstract

This study aims at illustrating the role that legislation holds in the consolidation and protection of the national identity. The legislative trend in protecting the national identity proceeds in two directions. The first direction is to consolidate and embodiment the concepts of the national identity by enhancing its components and dimensions, while the second one is to provide penal protection for all behavior that undermines the national identity. In the light of this, the researcher addressed the national identity and its components and reviewed the different types of national identity, whether individual or collective, as well, he reviewed crises that confront national identity and the role of legislation in entrenching national identity concepts by reviewing the principles enshrined in the Jordanian Constitution, which defined the foundations and basis of the national identity and what is stipulated by the Law on the Organization of General Elections by specifying who may be a voter or candidate in which the national identity concepts are obviously defined. The researcher addressed the partial protection of national identity in Jordanian penal legislation by reviewing and analyzing texts affecting national identity whether contained in the Penal Law or Cybercrime Law.
