THE CONCEPT AND FEATURES OF THE LEGAL MECHANISM OF SOCIAL PROTECTION FOR JUDGES IN UKRAINE

Abstract

The article's objective is to elucidate the fundamental components of the legal mechanism for the social protection of judges in Ukraine. The author delineates this mechanism as a distinct legal structure that harmonizes seamlessly with legal principles and is grounded in current legislative norms. It comprises an all-encompassing array of measures and methodologies for social protection, carried out by authorized bodies in diverse forms. Firstly, this mechanism conforms to Ukraine's overarching social policy, reflecting its identity as a social and legal state, and aligning with its justice policy. Secondly, it embodies a system where elements are meticulously coordinated to enable the creation and facilitate its operation, adhering to the relevant range of responsibilities. The main components identified by the author include principles of social protection for judges, normative legal acts that govern this sphere, the entities involved in the system of social protection, and the various forms that define the primary coverage areas for social protection of judges. Thirdly, this legal mechanism fulfills a complex array of functions, including organizational, preventive, restorative, and balancing functions, among others. Fourthly, the legal mechanism for judges' social protection is rooted in general legal principles as well as special and specific principles, alongside legislative norms that collectively constitute its foundation. Fifthly, this legal mechanism carries significant social and legal significance. In conclusion, the author emphasizes the theoretical and practical importance of the legal mechanism for judges' social protection. The article concludes that the legal mechanism for social protection of judges in Ukraine, while primarily theoretical, has practical implications for the actual implementation of these measures. Firstly, the conceptual foundations underlying this mechanism emphasize the essential role of ensuring a judge's social security through proper social protection measures. This not only reflects the importance of judges to the existence of the state as a legal, democratic, and social entity but also underscores their unique role. Secondly, the importance of this role should not become an excuse for neglecting the social security of these vital workers. The legal mechanism recognizes judges' legitimate expectations of adequate state protection against social risks, preventing a critical level of social vulnerability. In essence, while the legal mechanism may seem abstract construct, it has tangible effects on the social protection of judges, affirming their special status within the state structure and their rightful expectations of support.
