FEATURES OF CIVIL–MILITARY INTERACTION DURING THE LEGAL REGIME OF MARTIAL STATE

Abstract

The purpose of the article is to characterize the features of civil-military interaction during the legal regime of martial law. The article substantiates that civil-military interaction is an important factor in ensuring the integrity of the military management system, increasing the effectiveness of the functioning of the Armed Forces of Ukraine and other military formations, taking into account the position of the public when making decisions related to the activities of the security and defence sector. The legal regime of martial law conditioned the strengthening of the military component of the state management system. The consequences of the introduction of the specified legal regime determined the content and direction of cooperation between the civilian and military components. The main features of civil-military interaction today include: a) the large-scale nature of interaction, which involves the coverage of almost all social groups and their involvement in the processes of providing material, intellectual, methodological, psychological and other assistance to military formations; b) granting subjects of military-legal relations additional powers in accordance with the legislation on the legal regime of martial law; c) the special nature of information exchange, which involves the non-disclosure of some information and data to civilian partners in interaction; d) activation of public structures, the activities of which are aimed at helping military formations to maintain integrity. Current problems of the modern stage of the development of the system of civil-military cooperation are improving the regulatory and legal basis of the specified work, ensuring the provision of special knowledge in this field to military personnel who were recently mobilized and do not have experience in participating in the specified activity, as well as the development of methodological approaches to cooperation with civil society institutions that provide assistance to both civilians and military units.
