REGARDING LEGAL REGULATION ALIENATION AND REALIZATION OF MILITARY PROPERTY

Abstract

In the context of martial law, the legal regulation of decommissioning and alienation of military property may face a number of problems that should be taken into account: insufficient clarity of legislation β€” as the legislation may not be sufficiently clear or detailed in defining the procedures and conditions for decommissioning and alienation of military property. The lack of specific norms and definitions can lead to disagreements and misunderstandings; the lack of control mechanisms means the lack of effective control mechanisms and supervision over the processes of decommissioning and alienation can lead to corruption, abuse and unfair use of military property; insufficient protection of property rights is manifested in the fact that if effective protection of property rights is not ensured, there may be a risk of illegal seizure or use of military property, which may violate the rights of individuals or organizations; insufficient public participation, that is, public participation in decisionmaking regarding the write-off and disposal of military property may be limited. This can cause mistrust and conflict between the government and the public; financial aspects are manifested in the transparency of financial transactions related to the write-off and alienation of military property. Insufficient reporting may raise doubts about the efficient use of resources; international standards β€” if a country enters into international obligations or receives assistance in the field of military property, it is important to consider international standards and requirements in this context. Solving these problems may include improving legislation, creating effective control mechanisms, ensuring transparency and openness in the processes of write-off and alienation of property, as well as involving the public and stakeholders in decision-making. Improving the legal regulation of the alienation and sale of military property is an important task for ensuring the effective use of defense resources, ensuring national security, and ensuring transparency and accountability in the management of military assets. Below are several possible directions for improving legal regulation in this context: creation of an updated unified and understandable regulatory act regulating the alienation and sale of military property; implementation of a system of accounting and inventory of military property to avoid its losses and provide accurate information about available resources; ensuring transparency and openness in the processes of alienation and sale of military property. Development of external and internal control mechanisms, including the involvement of the public and the non-governmental sector; implementation of modern methods of assessing the value of military property to ensure its correct value and sale on the market; establishment of clear norms and rules for holding public auctions for the alienation of military property to ensure a competitive and fair sale process; the use of modern information technologies to facilitate the processes of accounting, monitoring and management of military property; establishment of mechanisms of responsibility for violations of the rules of alienation and sale of military property, including administrative, civil and criminal sanctions. These measures can contribute to the creation of an effective and transparent system of military property management, ensuring its optimal use in the interests of national security and stability.
