ANALYSIS OF CITIZENS’ VIEWS ON THE PRESUMPTION OF CONSENT AND DISSENT IN HUMAN ANATOMICAL MATERIAL TRANSPLANTATION

Abstract

Introduction. Due to problems with the shortage of human anatomical materials for transplantation, the question of how to address this issue becomes relevant. The article will analyze the field of transplantology and the influence of citizens' views on legislative acts. Based on current legislation, the author of the article will dissect current issues on the defined topic with the possibility of their resolution. Objective. The purpose of this article is to highlight current problems in the legal aspect of understanding the development of transplantology in Ukraine, considering contemporary challenges, and analyzing the awareness, views, and opinions of Ukrainian citizens and their influence on legislative acts regarding the highlighted topic. Materials and Methods. The material is prepared based on a sociological study (comment on your view on the field of transplantology), involving spontaneous polling of respondents of different gender, age, social status, and education levels. It includes a quantitative analysis of data collection and obtaining primary empirical information about specific opinions, knowl-edge, and social facts that constitute the subject of the study. This is done through written and individual interaction between the researcher and the respondent regarding the specified population based on the inductive principle. Results. During the study, it was found that most students have a low level of awareness of the problem of the shortage of human anatomical materials for transplantation. According to the research results, 40% were in favor of introducing a presumption of consent, while the remaining 60% were against it. However, one-third of those who voted against it consider introducing the presumption of consent due to moral aspects and personal fears. In conclusion, it can be noted that the low level of popularization of the transplantation of human anatomical materials in Ukraine is a gap in legislation since it is one of the decisive aspects of decision-making and understanding of the surrounding issues in the medical field. Perspectives. In future scientific research, it is proposed to focus on analyzing the impact on the development of transplantology, namely obtaining consent or dissent for post-mortem donation in different countries worldwide.
