Abstract

The article is devoted to the study of the powers of local self-government bodies in the field of land relations regulation. Relevant powers and the specifics of their implementation under martial law are analyzed. An analysis of legislative changes was carried out and suggestions were made regarding the further improvement of the legislation in terms of the implementation of land powers by local self-government bodies under martial law. Detailed attention is paid to the issue of giving consent to a citizen for the development of documentation on land management, approval of documentation on land management and the provision of a plot of land in the ownership of a citizen, and the issue of the implementation of powers delegated to local self-government bodies in terms of state control over the use and protection of land in the event that the council adopts a corresponding decision to implement such control. The conclusion regarding the need to make relevant legislative changes that can partially unblock the issue of privatization of state and communal land plots by leaving the prohibition on the free transfer of state and communal land into private ownership, granting permits for the development of land management documentation for the purpose of such a free transfer, and developing such documentation in the territories where hostilities are (were) conducted or temporarily occupied by the russian federation. On the basis of the analysis of the existing judicial practice, a conclusion was made about a rather ambiguous approach of the courts to the consideration of cases regarding the approval of land management documentation. Attention is focused on the fact that today there are certain restrictions on the implementation of control functions for the use and protection of land by local self-government bodies.
