DEVELOPMENT OF ALTERNATIVE ENERGY LAW IN THE CONTEXT OF ENERGY TRANSFORMATION OF UKRAINE

Abstract

The article is devoted to the study of the peculiarities of development of alternative energy law in the context of Ukraine's energy transformation. The author substantiates the possibility of internal differentiation of the right to use alternative energy sources into blocks: the right to geogenic renewable energy sources, the right to man-made renewable energy sources, and the right to secondary energy resources. The author argues that the development of alternative energy law and legislation is of particular relevance in the process of Ukraine's energy transformation due to its European integration and post-military components. They require new technical and technological products and innovative solutions provided by comprehensive, intersectoral regulation not only by the provisions of energy, electricity, gas, and energy efficiency legislation, but also by related energy-related provisions of environmental, natural resource, land, economic, investment, industrial, housing, transport, international, administrative, tax, customs, and criminal legislation. The author suggests that in the context of transformation of coal regions, it is necessary to distinguish between economic activities and natural processes accompanying relations with respect to coalbed methane. The author proposes a conceptual vision of the development of alternative energy law in terms of systematization of its sources not only at the level of the Energy Code of Ukraine, but also at the level of the internal structure of the volume “Energy Law”, which, in addition to books on “traditional” energy resources, will include the book “Alternative Energy Law”, where the relevant sections, subsections and chapters will reflect the regulations for the regulation of a specific set of energy relations. The author identifies the formation and regulation of relations between the “alternative energy source — alternative energy facility (mono- or combined) — location of the alternative energy facility (man-made, geogenic or techno-geogenic facility, resource)” as one of the promising areas for further development of alternative energy law.
