Unprotected Consumers And Consumer Protection Legislations- An Introspection

Abstract

In India the need of the consumer protection becomes necessary on account of economic imbalances, illiteracy, invention of technological devices and inequalities in society. We have achieved consumer protection to a large extent by enacting Consumer Protection Act, 1986 which is an innovation for the better protection of consumers. It provides effective safeguards to consumers against supply of defective goods, deficient services, Unfair Trade Practices and Restrictive Trade Practices. Unfair Trade Practices is prohibited under Drugs and Magic Remedies Act, 1954, which prohibits advertising of medicines of some diseases and disorder, claiming magic effect. Likewise, Competition Act, 2002 is also against the dominant position hold by some companies and excessive expenditures on advertisements but in spite of having catena of legislations on protection of consumer rights we are unable to protect consumer rights. Author have gone through several Newspapers & Magazines it is found that some companies and firms are infringing the Consumer Rights in secretive manner.
