Abstract

Problem setting. The Memorandum on lifelong learning of the European Union proclaimed that the successful transition to a knowledge-based society and economy should be accompanied by lifelong learning. The legislation reform on higher and postgraduate education has been carried out in Ukraine. But the legal principles of professional and creative potential of teachers in the system of postgraduate education and of management of this process haven't been settled yet . The target of the research. This article identify and study the administrative and legal aspects of professional and creative potential of teachers in the system of postgraduate education. Analysis of recent researches and publications. Zyazyuna I., V. Kremen, G. Artyushyna, A. Lyubchuk, R. Shapoval, V. Miller, Vladimir Oleinik, EV Chernysheva and N. Klokar, A. Kuzminsky, LA Pokroyevoyi and others dedicated theirs researches to the analysis of various aspects of this issue. Article's main body. The right on education enshrined in the Constitution of Ukraine. In the Law of Ukraine "On Education" and "On General Secondary Education", State National Program "Education" ("Ukraine XXI Century"), National Education Development Doctrine refers to the teaching staff state guarantees concerning with improving their skills. Postgraduate education belongs to the structure of education in Ukraine. The Law of Ukraine "On Education" defines this concept and types of postgraduate education, including advanced training. Currently, there is no separate regulation act that would take into account the specifics of this structural level of education, that would setting out the legal principles of organization of educational process in post-graduate education. There are also no state standards of postgraduate education. The experts drafted the Law of Ukraine "On postgraduate education" and the draft Regulations on postgraduate education in higher education. Such legislative activity meets the basic principles of modern European society in our country after the signing of the Association Agreement between Ukraine and the European Union, the European Atomic Energy Community and their member states. Prospects for postgraduate education are considered on the basis of international experience of teachers' training system establishment based on the differentiated approach and adaptation of current legislation to EU standards. Conclusions and prospects for the development. Modern society recognizes the education sector as one of the most important for human activity. In Ukraine the principles of educational activities in postgraduate educational institutions governed by a number of laws and regulations, but there is no separate legal act that clearly setting out the peculiarities of this level of education. A draft Law of Ukraine "On postgraduate education" and the draft Regulations on postgraduate education in higher education have been developed. Among the priorities is to develop the State standard of postgraduate education and to adopt the new Law "On General Secondary Education". The legal basis of evaluation of professional formation of teachers-creativity while postgraduate education and legal support that will meet the European educational standards should be improved.
