THE MODERN PECULIARITIES OF THE CRIME SCENE INVESTIGATION AT TRANSPORT INFRASTRUCTURE OBJECTS AND THE FUTURE LAWYERS TRAINING: OVERCOMING CONTRADICTIONS

Nowadays the Constitution of the Russian Federation, federal law (FL) on electronic document flow of Russia, Civil Procedure Code of the RF, Administrative Violations Code of the RF, Administrative Procedure Rules of the RF, Arbitration Procedure Code of the RF, Criminal Procedure Code of the RF, Federal Law on customs procedures, the tax code of the Russian Federation, etc. are the legal basis of lawyers’ activity. Aimed at creation of the unified legal discipline (law-abiding), training human resources ? legal theorists should be based on the principles of legitimacy, observance of human rights and fundamental freedoms, freedoms of juridical person as well as the independence of an expert, investigator, interrogating officer (law enforcer); on objectivity, comprehensiveness and completeness of research (relevant proof) conducted with the use of modern scientific and technological achievements. These and other issues are to be developed within the framework of State practice and abiding the international standards, which Russia guarantees. According to the authors, basising on the analysis of the normative legal acts (NLA) and various researches, the activity of educational institutions, security issues and forced or other evidentiary proceedings should be conducted aiming at ensuring and implementing legitimacy and legal procedure of the corresponding federal legislation.
