Abstract
This article deals with the rules for the protection of Human Rights of Women. We treat here the relationship between International Standards and Guidelines of the Brazilian legal system to deal with the Protection of the Right of Women. We address the hierarchy of International Human Rights Treaties, which address gender issues, making a discussion with the monistic and dualistic theory to theory, then analyze the influence of the major international treaties on Human Rights of Women in the creation and implementation of the Law Maria da Penha. Also consider the constitutional supremacy of International Human Rights Protection of Women, which are incorporated into the national legal system to force a Constitutional Amendment
