PARA VAKIFLARININ BİR UYGULAMASI OLARAK MUÂMELE-İ ŞER‘İYENİN MEŞRÛLUĞU ÜZERİNE

Money foundations are the leading institutions established in the Ottoman Empire in order to meet cash needs. However, the establishment of money foundations has been the subject of legal discussions. In addition, there has been debate around the nature and provision of the Muâmele-i Şer'iyye, which is a common practice of these foundations, and whether this transaction is aimed at receiving interest. In this study, after giving a brief information about cash waqfs, the legality of the Muâmele-i Şer'iyye was evaluated.
