Abstract
In this article the author considers provisions of the European Convention on Human Rights and the Protocol № 12 to the Convention concerning discrimination. He analyzes practice of the European Court of Human Rights on application of those provisions. The article draws attention to the standard of proof and the burden of proof in cases of discrimination, and also considers the possibility of States to implement policy of positive discrimination.
