Leaving in danger: the ratio of article 106 of the criminal code and article 125 of the criminal code

The scientific article is devoted to the problems of the ratio of Art. 106 of the Criminal Code of the Russian Federation and Art. 125 of the Criminal Code of the Russian Federation. The subject of the scientific article is the norms of criminal legislation, as well as judicial practice. The relevance of this article lies in the fact that leaving in danger and killing a newborn child by a mother are crimes that are part of the group of crimes against the safety of life and health. In addition, the use of these articles of the Criminal Code is due to a complex of problems, which are primarily determined by the existing evaluative categories, the interpretation of which is presented in the doctrine of criminal law. The article provides a detailed analysis of the scientific literature and judicial practice on the issue under study, describes the existing in theory and practice problems of qualification of the indicated corpus delicti. The conclusions are confirmed by the materials of judicial practice.
