THE IMPACT OF TRANSPARENCY ON MUTUAL RELATIONS BETWEEN UKRAINE AND THE EU

Abstract

One of the strategic partners of the European Union is Ukraine, which declares its desire for comprehensive integration into this international legal institute. An important step in the EU-Ukraine cooperation is the Association Agreement ratified in 2014, and compliance with the principle of transparency is a crucial factor in their cooperation. Within the framework of cross-border cooperation, transparency can be given to the role of a legal institute and a legal regime created on its basis, composed of a complex of legal relations regarding the accessibility of various information subjects. The principle of transparency is one of the fundamental principles of the European Union as a sui generis association. At the same time, the concept of «transparency» can be viewed from different points of view — both from the economic (the issue of transparency in trade) and from the political and legal (transparency of institutions and decision-making processes). The strategic guideline for which the state-legal development of Ukraine can be characterized as integration into the European political, economic and humanitarian space. From a political and legal point of view, cooperation with the EU can be considered as contributing to the deepening of democracy and respect for human rights, the improvement of the national legislative framework. Because of this, the various areas of work that the European Union, as the most influential integration association of the states of Europe, traditionally arouse great scientific interest among domestic and foreign scholars in the legal fields, such as international, constitutional law, theory of state and law. Our country's relations with the EU since the first political and technical and financial declarations by the EU have become co-operation on a wide range of issues in various fields, involving a significant number of government officials, partners, individual citizens and others. It is within the framework of cross-border cooperation that transparency can play the role of a legal institute and a legal regime created on its basis, composed of a complex of legal relations regarding the accessibility of various information subjects. Their interest in the completeness and authenticity of the data is unimpeded (of course, given the elements of accessibility to some extent and under certain conditions).
