REGULATORY BASIS OF SPACE ACTIVITIES: MODERN CHALLENGES

Abstract

The article is devoted to the analysis of basic international legal acts on space activities. The mechanism of the right regulation of outer space is a set of: 1) declared international guarantees for the implementation of outer space, based on recognition of it as a value that cannot be nationalized, appropriated or damaged; 2) national legal means of influencing the space relations that arise in the exercise of space activities by a particular country or its representatives; 3) the rules of private space law, which is at the stage of formation. The paper concludes that the regulatory framework of space international law needs updating because it no longer controls the dynamics of space activity. It is clear that since the adoption of the first acts, space legislation has been gradually updated, as evidenced by the presence of relatively modern international instruments. However, most contemporary issues are still outside the scope of international space law, as it falls outside its scope. Therefore, international standards of space exploration and use are inherently international safeguards for space exploration — a set of permanent rules that represent the freedom of the cosmos and its celestial bodies from any conflict situations based on the responsibility of wrongdoing in therefore, violations of the order of exploration and use of outer space are not intended. In the modern paradigm of scientific knowledge of space, they need to be updated in terms of their flexibility and adaptability to the practical challenges of today.
