PRINCIPLES OF LEGAL REGULATION OF LABOR PAYMENT AS THE BASIC GUIDELINES OF THE INSTITUTE OF LABOR PAYMENT

Abstract
The article analyses the views of scientists on the principles of legal regulation of remuneration, on the basis of which certain conclusions are drawn. It is stated that the principles of legal regulation of remuneration play a fundamental role, reflect the guiding ideas that contain and regulate the content of the legal regulation of this process on the basis of legal norms established by the current legislation of Ukraine. These principles enshrine the content of legal acts (both international and domestic), reflecting such universal values as the desire for freedom, equality, justice, the rule of law. It is the principles that determine the content of national legislation in general and legislation in the field of remuneration, in particular. They should be derived not from legislation that aims at streamlining wages, but from those values and ideas that prevail in society. Based on the provisions of the labor legislation of Ukraine, the following principles of remuneration are distinguished: the principle of unity and differentiation; the principle of correlation between productivity and pay; the principle of guarantee of payment of labor; the principle of proper remuneration; the principle of taking into account the amount of the minimum wage established by the state; the principle of non-discrimination in pay; the principle of equal pay for equal work, the principle of the inevitability of protection of the right to remuneration; the principle of choosing a rational system of payment (part-time, hourly, their variants) for individual employees; the principle of material interest. It is stated that their observance will provide an opportunity to solve one of the most pressing problems, namely to improve the standard of living of people. If the workers have the appropriate level of wages, then the welfare of the population, as well as the economic level of our country, will increase. It is proposed to consolidate at the legislative level the new Labor Code of Ukraine outlines the principles of legal regulation of remuneration, taking into account the rules of international legal regulation of remuneration.
