RECONHECIMENTO DAQUELE QUE SEMPRE FIGUROU COMO PAI: NOVO MODELO DE RESPONSABILIDADE PARENTAL

Abstract
Nowadays, parental relationships, which form the family nexus, go beyond the consanguineous connection and give space to the socio-affective issue. Based on the legal principle of affectivity, the objective of this article is to analyze the new Brazilian modelfamily. Thus, contemporary jurisprudence, together with legal doctrine, defends the thesis that father/mother are those who are connected in some affective way, with the child, and who exercise the precepts of human dignity and interest of the child that the Federal Constitution, and the Statute of the Child and Adolescent bring respectively. In this sense, the methodology used is based on an exploratory, descriptive and bibliographical research with the purpose of reviewing the academic literature on the subject exposed. The results found describe that this new model of parenting, legally recognizes the relationships according to the interests of the parties involved: parents and children; transcending the biological issue and focusing on the bonds acquired through social and affective relationships, as well as, in supporting the identity and interest of the child.
