FORMS OF USING EVIDENCE DURING THE PRE-TRIAL INVESTIGATION OF CRIMINAL PROCEEDINGS ON THE CREATION OF UNFORESEEN PARAMILITARY OR ARMED GROUPS

Abstract
The article analyzes the forms of use of evidence during the pre-trial investigation into the creation of paramilitary or armed groups not provided by law. We believe that evidence is used not only to formulate and substantiate conclusions (decisions), but also to put forward, build and test versions in criminal proceedings, imaginary modeling of the crime and its reflection in the environment, the dynamics of traceability, and so on. These processes combine sensory-practical and analytical activities. It is due to the organic combination of these processes that the conclusions (decisions) in criminal proceedings are a synthesis of sensory-practical and mental activity of the subjects of evidence. This article proves that evidence is used not only to make procedural decisions, but also plays a significant role in conducting evidence during the pre-trial investigation of criminal proceedings on the creation of non-statutory paramilitary or armed groups, because only on the basis of properly prepared evidence subject of evidence, it is possible to conduct an effective pre-trial investigation. A pre-trial investigation will be sufficiently substantiated if it is based on specific facts used in criminal proceedings.
