PROBLEM ISSUES REGARDING THE PREVENTION AND COMBATATION OF DOMESTIC VIOLENCE AND GENDER-BASED VIOLENCE IN PRACTICAL ACTIVITIES

The author highlights problematic issues in law enforcement, practical activities in the field of countering and preventing domestic violence and gender-based violence. The concepts of «gender-based violence» and «domestic violence» are analyzed, common features and differences of these definitions are given. The main provisions of the Law of Ukraine «On Prevention and Combating Domestic Violence» were analyzed. Using the method of analysis of regulatory legal acts, the possibilities and ways of eliminating legislative gaps in the above-mentioned direction were considered. The norms of the current legislation have been analyzed. Examples of the implementation of the norms of the Convention of the Council of Europe on the prevention of violence against women and domestic violence and the fight against this phenomenon are given. The advantages of the newly introduced sanctions for police bodies directly engaged in preventive activities regarding domestic violence are given. The article examines the problem of effective application of the current legislation on the prevention and counteraction of domestic violence in practice. Data on the number of sentences in the Unified State Register of Court Decisions for 2022 are provided. Statistical data on the indicators of imposed sanctions are presented, in this context, the structure of offenders by gender is analyzed. Indicators of the commission of administrative offenses in the field of domestic violence and gender-based violence over the past years are also given. Forms of domestic violence by gender are given. Subjects that ensure prevention and countermeasures against domestic violence are singled out. Measures to combat domestic violence were analyzed. The main tasks assigned to state authorities, which ensure the prevention and counteraction of domestic violence in Ukraine, are summarized. Suggestions for improving correctional programs for work with offenders are given. The need to expand the powers of the National Police was emphasized. Measures are proposed to restore public trust in the subjects of combating domestic violence, as well as preventive measures to prevent misdemeanors under the article of domestic violence.
