The influence of the state on the service institute in local government bodies in Ukraine

The article is devoted to the theoretical substantiation of the essence of the influence of the state on the institution of service in local self-government bodies, based on the provisions of legislative acts. It is established that the level of the State influence on the institution of service in local self-government bodies, in contrast to the characteristics of the content of service in local self-government bodies and the status of local self-government officials, is poorly researched in the field of knowledge of public management and administration. It was determined that the influence of the State on the institution of service in local self-government bodies is a set of public policy directions established by the State in laws, which determine the actions of authorized public authorities regarding the regulation of the professional activities of Ukrainian citizens in local self-government bodies. The characteristic features of the influence of the State on the institution of service in local self-government bodies were studied, based on the provisions of the laws of Ukraine, which were, are and will be regulated. Based on the analysis and comparison of the directions of the State policy defined by the Laws of Ukraine "On Civil Service" dated December 16, 1993 No. 3723-XII, "On Service in Local Self-Government Bodies" dated June 7, 2001 No. 2493-III and "On Service in Bodies of local self-government" dated May 2, 2003 No. 3077-IX, the peculiarities of the influence of the State on the institution of service in local self-government bodies are highlighted. It is proposed that the influence of the State on the service in local self-government bodies should be considered, taking into account the three stages of development of the institution of service in local self-government bodies in Ukraine, due to the time limits for the adoption and operation of these laws. It is substantiated that the third stage of the development of the institution of service in local self-government bodies, which will begin with the entry into force of the Law of Ukraine "On Service in Local Self-Government Bodies" dated May 2, 2023 No. 3077-IX, will be characterized by the growing influence of the State on the institution of service in local self-government bodies by the criterion of the level of legal regulation, minimization by the level of financial support and will remain unchanged by other criteria. It is stated that this approach of the State is based on the norms of the Constitution and laws of Ukraine, in particular the Law of Ukraine "On Local Self-Government in Ukraine", corresponds to the European Charter of Local Self-Government and its economic capabilities
