ON THE QUESTION OF THE TRAINING OF MILITARY LAWYERS IN HIGHER MILITARY EDUCATIONAL INSTITUTIONS IN THE CONDITIONS OF WAR

Abstract

The article examines the peculiarities of the training of military lawyers in higher military educational institutions in the conditions of war. It is noted that the training of military lawyers in the conditions of war in Ukraine plays a critical role in ensuring legal support and compliance with the norms of international and national legislation in accordance with the conflict situation. In the process of training military lawyers in the conditions of war, some aspects should be taken into account: specialized education — military lawyers must receive specialized education in international humanitarian law, military law, human rights, law of armed conflicts and other relevant areas of law. This will help them better understand the norms and limitations of military conflict; up-to-date information — military lawyers must have constant access to up-to-date information about changes in legislation and international norms in the field of military law. This is important so that their decisions are relevant to the latest developments; practical training — military lawyers must receive practical training that will allow them to apply theoretical knowledge to practical situations in war conditions. This may include simulations of legal situations, training in cooperation with military commanders and other specialists. The training of military lawyers is critical in wartime to ensure compliance with legal norms and protect the rights and freedoms of military personnel and civilians. However, there are some weaknesses in this process that can be improved. Here are some of them and possible ways of improvement: obsolescence of programs — some training programs for military lawyers may be outdated or insufficiently oriented to modern requirements and realities of military conflict. Ways of improvement — regular updating of training programs and inclusion of actual practical aspects of military law and international humanitarian law; insufficient practical training — military lawyers may not have sufficient practical training to apply theoretical knowledge in real situations. Ways of improvement — inclusion of more practical training, simulations and internships in real legal environments; lack of coordination with other services — military lawyers may find it difficult to interact and coordinate with other military and civilian services. Ways of improvement — organization of joint trainings and trainings with other specialists, development of cooperation and communication protocols; insufficient understanding of international standards — military lawyers may have a limited understanding of international standards of humanitarian law and human rights. Ways of improvement — inclusion of more material on international law in educational programs, providing access to international documents and resources; lack of training for stressful situations — in wartime, military lawyers may find themselves in stressful and difficult situations that require special training. Ways of improvement — including trainings on psychological preparation and stress management; communication effectiveness — military lawyers may have difficulty communicating effectively with different structures and groups. Ways of improvement — development of interpersonal and group communication skills, public speaking trainings; insufficient emphasis on the humanitarian aspect — in the preparation there may be insufficient emphasis on humanitarian protection and observance of human rights during a military conflict. Ways of improvement — inclusion of additional material and training on humanitarian law and protection of civilians; improving the training of military lawyers in the conditions of war in Ukraine requires a systematic approach focused on the practical needs and realities of the military conflict, as well as constant updating and adaptation of training programs.
