PROBLEM ISSUES OF THE CLASSIFICATION OF INFORMATION IN THE NATIONAL LEGISLATION OF UKRAINE

The article deals with the peculiarities of the classification of information in the national legislation of Ukraine, its characteristic features and shortcomings. As a result of the research, it was found that the lack of a clear species distinction in the current legislation of classified information leads to the need to revise the existing classification of such information in order to avoid disagreements regarding the legal status of its species, and the irrational formation of the protection system. In particular, the provisions of current legislation of Ukraine indicate that, for example, there are a number of cases when similar characteristics are applied to secret and confidential information, moreover, the same classified information, based on the norms of laws, can be classified by different. In addition, the development of the information society, in particular accelerated informatization, the globalization of information relations, the nature of social relations create new challenges for the classified information system. Given to the fact that Ukraine is a democratic state, in which human information rights and their guarantees determine the content and direction of the state's activities, there is a need to make changes to the current legislation of Ukraine on the regulation of the information sphere, in particular in terms of achieving a proper balance between the right to access information and limiting access to information through proper legal regulation of the information system with limited access in the national legislation of Ukraine.
