Abstract

The article is devoted to the study of legal bases and features of legal liability for violations of legislation in the field of protection, use and reproduction of rare and endangered species of flora, listed in the Red Book of Ukraine. The choice of the topic is due to the fact that today one of the most important tasks is the rational and effective use of natural resources, their reproduction and protection of the natural environment in order to ensure environmental safety. It was established that the importance of environmental protection is explained by the fact that the future existence of humanity depends precisely on the solution of the issues of ensuring safe living conditions for citizens and society, preserving the state of the environment. In this regard, solving the problems of environmental protection, rational and effective use of natural resources is becoming especially urgent. It has been proven that success and results can be achieved only by defining and taking effective measures, including those of a legal nature, such as establishing legal responsibility for offenses in the environmental sphere. Based on official data, the ecological state of rare and endangered plant species listed in the Red Book of Ukraine on the territory of our country is characterized. It was emphasized that when determining the peculiarities of their legal regime and establishing legal responsibility for violations in the sphere of their protection, use and reproduction, one should take into account first of all such natural characteristics as limitation, value, vulnerability and uniqueness. The norms of current domestic legislation, in particular, criminal, administrative, ecological, including floristic, regarding the establishment of legal responsibility for offenses in this area were analyzed. Based on the results, shortcomings and gaps were identified, proposals for improving the prescriptions of regulatory and legal acts, including the ecological (in particular, floristic) direction, were provided and substantiated. It was proven that, taking into account the special legal status of rare and endangered plant species listed in the Red Book of Ukraine, there is a need to establish increased legal liability (criminal, administrative, civil, etc.) for violations in the researched area.
