EXCLUSION AND RELEASE FROM ECONOMIC AND LEGAL RESPONSIBILITY IN THE FIELD OF ENERGY

Introduction: the article analyses the current state of research on grounds for exclusion and exemption from economic and legal responsibility (hereinafter — grounds) in general and in the field of energy separately, the existing grounds in the field of energy are investigated. The role and place of state bodies in the formation and regulation of grounds in the field of energy, the specifics of their application in the field of energy, and existing problematic issues of its application are studied. Ways to improve the regulatory framework in the field of energy, relevant research and development are proposed. Purpose: identify patterns in the application of the grounds for exclusion and exemption from economic and legal responsibility in the energy sector, to reveal the grounds, main features, differences between exclusion and exemption from economic and legal responsibility in the energy sector in the modern conditions of its existence after the creation of energy markets in Ukraine (natural gas and electricity markets), the introduction of quarantine in connection with the incidence of the COVID-19 virus, the full-scale invasion of the Russian Federation into Ukraine to identify the essential signs of such grounds in the field of energy. Materials and methods: the research materials are: 1) regulatory and legal acts determining the grounds for exclusion and exemption from economic and legal responsibility in the field of energy 2) works of domestic and foreign authors conducting their scientific and practical research in the field of grounds for exclusion and exemption from economic and legal responsibility 3) practice of domestic courts. In the process of carrying out the research, the following scientific methods were used: theoretical generalization and grouping; formalization, analysis and synthesis; logical generalization of results (formulation of conclusions). Results: the scientific article revealed the main regularities in the application of grounds in the field of energy, revealed the grounds, main features, differences between exclusion and exemption from economic and legal responsibility in the field of energy, provided actual examples of the application of such grounds to business entities. Prospects: in further scientific research, it is proposed to focus attention on practical recommendations, the implementation of which will make it possible to fully implement the measures of exclusion and exemption from responsibility in the field of energy.
