LEGAL CONCEPT OF BIOLOGICAL WEAPONS THROUGH THE PRISM OF ENVIRONMENTAL SAFETY IN THE CONTEXT OF ARMED AGGRESSION OF THE RUSSIAN FEDERATION

Based on a comprehensive analysis, the article examines the legal concept of biological weapons through the prism of environmental safety in the context of armed aggression of the russian federation. In accordance with the provisions of the Constitution of Ukraine, the State is obliged to ensure environmental safety of Ukraine. A certain prototype of biological weapons has been used in the historical plane before. It has been outlined the provisions of the Geneva Protocol for the Prohibition of the Use in War of Asphyxiating, Poisonous or Other Gases, and of Bacteriological Methods of Warfare. In the article it has been analyzed the provisions of the Convention on the Prohibition of the Development, Production and Stockpiling of Bacteriological (Biological) and Toxin Weapons and on their Destruction. Certain provisions of the Convention on the Prohibition of the Development, Production, Stockpiling and Use of Chemical Weapons and on their Significance have been noted. The definitions of environmental safety and biological safety have been analyzed. A conceptual analysis of the definition of the essence of biological weapons has been provided, its features have been characterized. Certain issues of biological weapons development in the Soviet Union have been outlined. It has been noted that even at the present stage of society's development there are laboratories that store certain strains of biological threats, such as smallpox: located in Atlanta (USA) and novosibirsk (russia). The expediency of using mobile systems adapted for the military to monitor certain external environmental factors related to the use of biological weapons is determined. It has been determined that the issue of production, proliferation, use and storage of biological weapons has already been used by the russian federation and can be further manipulated. It has been proved and emphasized that it was important for the international community not only to participate and be parties to international agreements on the production, proliferation and storage of biological weapons, but also to develop an effective mechanism for imposing sanctions on those member states that do not comply with the relevant provisions of international agreements.
