Need for Judicial Accountability and Restraint in the era of activism

The Judiciary, like the Executive and the Legislature, is the creature of the constitution and, hence, it would be worth while taking note of framework provided by constitution makers. Judicial activism and Judicial restraint are two sides of same coins. It is therefore essential to remember that judicial restraint in exercise of its functions is of equal importance for the judiciary its obligation under the constitution. Judicial activism should not become Judicial adventurism and thus, the court must act with caution and proper restraint. They must remember that judicial activism is not an unguided missile and failure to bear this in mind would lead to chaos.
