Problems of State Register of Immovable Property Rights and the State Land Cadastre in Ukraine: Possible Ways of Solutions

Abstract
In the conditions of deepening of socio-economic crisis in Ukraine critically important is a leadthrough of fasts and effective reforms, directed on proceeding in a national economy and increase of efficiency of the system of state administration, in this connection the special value acquires subsequent reform of the system of rights on the real estate’s registration. The purpose of this article is researching of the system of immovable property right’s registration, basic directions of reform of the indicated system and making of suggestions in relation to a subsequent improvement of the land registration legal relationships. To the moment of state registration of rights on lot land its forming must be carried out as object of civil laws. Forming of lot of the land is foreseen by determination of its area, limits and bringing of information, about it to the State Land Cadastre (ch.1 art.79-1 of the Land Code of Ukraine). In Ukraine the indicated stage and technically, and legally dissociated from the actually mechanism of state registration of rights on a lot, as forming of lot is carried out within the limits of the State land cadastre, and state registration of rights on lot ? in the State register of material rights on the real estate. Principles of co-operation of the indicated registers constantly change and reformed. One of basic directions of subsequent reformation registration-cadastre systems there must be automatic exchange of information up to creation of the unique informative system of Cadastre of the real estate and material rights on the real estate which will combine information about lot lands and objects of the real estate on the base of maintenance of independence of the State land cadastre and State register of material rights on the real estate and automatic exchange of information, state must provide free of charge.
