A EFICÁCIA EXPANSIVA DAS DECISÕES NO NOVO CPC: DO INSTITUTO DE ASSUNÇÃO DE COMPETÊNCIA E DO INSTITUTO DE RESOLUÇÃO DE DEMANDAS REPETITIVAS

The Social security law is a second generation right and, undoubtedly, fundamental to achieve the objectives of the State, previse in article 3, III of the Federal Constitution. Therefore, ana-lyzing the paradox of the irritation caused by the economics´ system in the social security law´s system is the main scope of this article, through a theoretical and scientific bias. It is also sought to verify the limits of the influence - if it´s possible and acceptable - of the environ-ment on workers' rights, what is the possible solution, from comparative law, to be adopted to avoid irreversible damage to the social well- being, the affectedness of the environment in social security law. As a result of the theoretical and empirical research it was observed that there is a practical example of Social Security Reform in Chile, which can be used as a para-meter for Brazil.
