O segredo de Kelsen: resenha de um livro imaginário sobre o fim do neoconstitucionalismo no direito brasileiro

This research problematize the end of neo-constitutionalism in Brazil and the new paradigm of différence, which in law appears like a legal pluralism. Through the relationship between Hans Kelsen´s and Kurt Gödel´s thoughts about the incompleteness of a symbolic system, this research observes the logical structure of the stratification process in Brazilian referents of law. The central point is the new regime of truth, behind the neo-constitutionalist discourses, on the spaces of production of sense of the law. In order to achieve these results, this research uses as a methodology the analytical contributions of the second phase of logical neopositivism, especially the analysis of the relation between Kurt Gödel's incompleteness theorem and the problem of the indetermination of the legal language in Hans Kelsen. As a result, the research signals the exhaustion of neo-constitutionalism and the triumph of legal pluralism: the juridical version of the paradigm of différence and its regime of truth.
