The legal system for the contract to use the trademark in the legislation of Algeria and the TRIPS Agreement

Abstract
The licensing contract to use the mark is one of the most successful mechanisms involved in transfer technical knowledge from developed countries to developing countries, Which would achieve the economic development of the countries that have enacted internal legislation to protect the parties to this contract, As well as to encourage them to conclude such contracts in light of the trademark and licensing contract new provisions contained in the TRIPS Agreement.Therefore, What is the compatibility of the legal system for the licensing of the use of a trademark in Algerian legislation with the new provisions of the TRIPS Agreement?. However, the analysis of the agreement and Algerian legislation provisions shows that the license contract in Algeria is subjected to the general substantive conditions of contracts. Therefore, the Algerian legislator should enact a legislative regime for licensing the use of trade marks, defining its regulatory frameworks and creating the appropriate legislative environment for its parties.
