ENERGY SUPPLY CONTRACT IN ECONOMIC LEGAL RELATIONS IN TODAY’S CONDITIONS

Abstract
For the development of every country, a reliably regulated and stably functioning energy supply is extremely important, since it directly affects the economic development of states, improvement of the quality of life, social stability, technological development, infrastructure, etc. Industry, agriculture, transport, the introduction of the latest technologies, innovations, water supply, heating, lighting of residential premises, the level of employment, the general state of satisfaction of the population, etc., directly depend on it. Taking into account the above, we can draw a brief conclusion that precisely thanks to the well-established energy supply system, which has been working for years all over the world, the world was able to achieve the prosperity and comfort for human existence that we can observe today. Therefore, an important issue that countries pay attention to is the qualitative legal regulation of energy supply in order to establish its stable availability. Ukraine is not an exception in this matter and also has relevant legislative acts aimed at solving the problems that arise in this field of state development. One of Ukraine's big steps in the sphere of ensuring regulation of energy supply between its subjects is the existence of contractual relations, in particular the existence of energy supply contracts, which are widely used in the process of implementing economic legal relations and help the parties that concluded them to solve urgent issues here and now, in within the limits stipulated by the current legislation and the relevant contract. However, the existence of a war on the territory of Ukraine drastically affected the possibility of functioning of energy supply in the country. The large-scale destruction of the energy infrastructure significantly affected the process of such supply, including the contractual obligations under the energy supply contract in the field of economy, because the fulfillment of some terms of the contract in the relevant realities of today is becoming increasingly difficult, and sometimes even impossible. In connection with this, the article focuses on the war itself, as a circumstance that has an extremely strong impact on contractual obligations in the field of energy supply. The consequences of its influence on the possibility of further, problem-free implementation of corresponding supply on contractual relations in the field of economy have been studied. In particular, attention was drawn to the expediency of distinguishing force majeure circumstances in the relevant contracts. The article also examines the features inherent in this type of contract, which is concluded in the process of implementing economic legal relations, such as an energy supply contract. The main aspects of the legislative regulation of the above agreements have been considered.
