A Comparative Study of Human Rights Criteria Regarding Prisoners in the Iranian Legal System and International Law

Abstract
Because crime, as a co-occurring phenomenon of society, has emerged from the very first days of the formation of human societies and social groups and has targeted their security and well-being, it has led human societies to confront it using a variety of social reaction tools. Prison as one of the first and most common tools of social reaction has always been considered and used by schools and legal systems in the world. The present article tries to comparatively review and criticize the rules and standards of human rights regarding prisoners in the Iranian legal system and the international arena. The method of this research is theoretical, descriptive-analytical and using interviews with experts in prison affairs and observation of the current situation of prisoners, the objectives of which can be examined in both scientific and practical positions. Finally, due to the lack of an independent non-governmental organization to guarantee the fulfillment of prisoners' human rights standards, the politicization of active institutions and lack of knowledge or low knowledge of the drafters of laws and regulations, practical suggestions with emphasis on the neglected category of security in prisons have been presented as a prerequisite for fulfilling any standard of human rights of prisoners.
